  • 1. Scope

(1) The following “General Terms and Conditions of Business” (GTC) apply in the version valid on the day of the order for all purchase contracts for products, services, maintenance/support services as well as seminars and webinars. Deviating agreements must be made in writing. By placing his order, the customer agrees to these GTC and is bound by them.
(2) Should individual provisions of these GTCs be invalid in whole or in part due to mandatory legal regulations (in particular the provisions of the Austrian KSchG), the remaining provisions of these GTCs shall remain valid without change.

  • 2. Conclusion of contract

Paradine GmbH reserves the right to change the content of the respective service offer at any time. All offers of Paradine GmbH (products, webinars, etc.) are subject to change without notice and are to be understood as invitation to the customer to make an offer himself. The contract is concluded by acceptance of the order by Paradine GmbH, either by sending an order confirmation by mail, fax or e-mail or directly by sending the ordered goods.

  • 3. Contract language

The content of the contract, all other information is offered throughout in German or English.

  • 4. Right of withdrawal in distance selling

(1) Customers who are consumers within the meaning of the Austrian Consumer Protection Act may withdraw from the purchase within 14 days of receipt of the goods without giving reasons.
It is sufficient if the declaration of withdrawal is sent within the period without giving reasons (to be sent to info@paradine.at).
(2) In the event of withdrawal, a refund of the purchase price shall only be made concurrently with the return of the goods received by the customer. Both the return of the goods and the reimbursement of the purchase price must take place within 14 days of the declaration of withdrawal. The customer shall cover the costs of the return shipment.
(3) Paradine GmbH shall charge an appropriate fee for the reduction in value for articles which are impaired or damaged by traces of use. The same shall apply if accessories (such as manuals, software, etc.) are missing upon return of the goods.
(4) There shall be no right of rescission in the case of software which has been unsealed by the purchaser, nor in the case of services which have been consumed or transmitted online (e.g. webinars, software and publications for downloading).
(5) Enquiries, information, data information and complaints are to be addressed to Paradine GmbH between 9 a.m. and 4 p.m. from Monday to Friday. T: +43-1-236 66 68 – 0

  • 5. Prices

(1) In principle, that purchase price for the ordered goods shall be deemed agreed which results from the current product description, price lists as well as course descriptions of Paradine GmbH.

  • 6. Terms of payment

(1) Unless otherwise agreed, invoices shall be due immediately upon receipt of the invoice, free of deductions and expenses.
(2) Invoices are issued in Euro.
(3) The statutory (default) interest according to § 1333 para. 1 ABGB (Austrian Civil Code) amounts to 4% per annum for non-merchants according to § 1000 para. 1 ABGB. – According to § 1333 para. 2 ABGB, the statutory default interest “between entrepreneurs from entrepreneurial transactions” (= two-way commercial transactions) amounts to 8% “above the base rate” (i.e. currently: 10.2% in total).
In the event of default in payment, the customer is obliged to reimburse all reminder and collection charges incurred by Paradine GmbH as a result of this default in payment and necessary for appropriate legal prosecution. Paradine GmbH reserves the right to assert a higher damage caused by default.
(4) Reaction time for complaints: Requests will be answered within 5 working days.

  • 7. Warranty

The warranty is subject to the legal regulations (24 months from receipt of goods). If replacement or improvement is not possible (not possible, too much effort, unreasonable, delay), the buyer is entitled to a price reduction or, if the defect is not minor, cancellation of the contract (redhibitory action). Compensation for (defect) consequential damages, as well as other property damage, financial losses and third-party damages against the customer, unless it is a consumer transaction, is excluded.

  • 1. Scope

(1) The following “General Terms and Conditions” shall apply to the attendance of events (seminars, webinars, workshops, events …) of Paradine GmbH. Deviating agreements must be made in writing.
With his registration for an event the customer declares his agreement with these General Terms and Conditions and is bound by them.
(2) If individual provisions of these GTC should contradict mandatory legal provisions (in particular the provisions of the Austrian KSchG), the remaining provisions of these GTC shall nevertheless remain valid.

  • 2. Registration

(1) Paradine GmbH reserves the right to change the content of the respective service offer at any time. All offers of Paradine GmbH (price lists of seminars, webinars, webshop…) are subject to change. The contract shall be concluded by acceptance of the registration by Paradine GmbH. If a registration cannot be accepted, the customer will be informed immediately.
(2) Registrations will be considered in the order of their arrival according to the available number of participants, registrations will be accepted in writing (also by fax, e-mail) or telephone. Each registration is binding.

  • 3. Contract language

The content of the contract, all other information, is offered throughout in German and English.

  • 4. Cancellations

(1) Cancellations can only be accepted in writing.
(2) Cancellations can be made free of charge up to 14 days before the start of the event. For cancellations received later than 14 days before the start of the event, a cancellation fee of 50% of the participation fee will be charged. From the start of the event, the full participation fee is due in the event of non-attendance.
(3) The naming of a replacement participant is possible at any time free of charge.

  • 5. Prices

(1) In principle, the participation fee shall be deemed to be agreed which is based on the current price lists of the seminars and webinars of Paradine GmbH.
(2) Unless otherwise stated, all price quotations are gross prices including statutory value added tax.

  • 6. Terms of payment

(1) The participation fee is to be paid before the start of the event by means of the registration confirmation free of deductions and expenses.
(2) The invoice is in Euro.
(3) A reduction of the participation fee is not provided for in the event of a later entry into an event; the same applies in the event of an early exit.

  • 7. Program Changes/Cancellations

(1) Due to the long-term planning of events, Paradine GmbH reserves the right to make organisational changes to the programme such as changes to dates, starting times, location or lecturers as well as event cancellations. The participants will be informed in time and in a suitable manner.
(2) Compensation for expenses incurred and other claims against Paradine GmbH may not be derived therefrom. The same applies to postponements of dates necessary at short notice.
(3) If an event has to be cancelled, any participation fees already paid will be refunded without deduction.

  • 8. Warranty

According to the legal regulations, the warranty is only valid for events.

  • 9. Contract data

The contract data are stored for invoicing purposes and can be retrieved at any time.

  • 10. Payment

Once you have selected a product you can choose the desired payment method:
You are welcome to choose invoice when choosing the payment method.
All other payment types are handled by the payment provider Global Procurement. If you choose this payment method, you will receive a link for the payment after submitting the order.

  2. credit card: VISA/ Verified by VISA, Master Card/Secure Code, Masterpass, GooglePay, Apple Pay

Your credit card data will not be stored by Paradine GmbH but will be transmitted encrypted via an external payment service provider.

In case of payment by credit card the debit will be made within one calendar week. When paying by credit card, the customer shall provide the following data: Cardholder, card number, credit card company, date of validity, CVV code. The data is transmitted using SSL encryption with at least 128-bit keys and is therefore not accessible to unauthorised persons.

  • 11. Compensation for damages

(1) Paradine GmbH shall only be liable for damages in case of intent and gross negligence, with the exception of damages to persons. The existence of slight or gross negligence shall be proved by the injured party unless it is a consumer transaction.
(2) Compensation for (deficiency) consequential damages and pure financial losses is excluded for entrepreneurs.
(3) Paradine GmbH shall under no circumstances be liable for the formal or content-related correctness of the information in event documents.

  • 12. Data protection

(1) The employees of Paradine GmbH are subject to the secrecy obligations of the data protection act.
(2) The customer acknowledges that the use of the data on the customer stated in the contract is stored and processed for the purposes of our bookkeeping and customer records. The data will be used to comply with legal regulations and to process payment transactions. Customer data will not be passed on to third parties, unless this is absolutely necessary for the execution of the contract. Contractual partners of Paradine GmbH have been instructed about these data protection provisions and are obliged accordingly.
(3) In the event of deliveries concerning services and products of Paradine GmbH (events, publications…) of any kind § 107 TKG (Austrian Telecommunications Act) shall apply.

  • 13. Data storage

We would like to point out that for the purpose of an easier shopping process and for the later contract processing the IP data of the connection owner can be saved by the web shop operator within the scope of cookies, as well as the name, address, UID number, telephone number and e-mail address of the buyer.

The data provided by you is necessary for the fulfilment of the contract or for the implementation of pre-contractual measures. Without this data we cannot conclude the contract with you. Data will not be transferred to third parties, with the exception of the transfer of credit card data to the processing bank institutes / payment service providers for the purpose of debiting the purchase price, to the transport company / shipping company commissioned by us for the delivery of the goods and to our tax consultant for the fulfilment of our tax obligations.

After cancellation of the purchase process, the data stored by us will be deleted. In the event of a contract being concluded, all data from the contractual relationship will be stored until the end of the tax law retention period (7 years).

In addition, the data name, address, purchased goods and date of purchase are stored until the expiry of the product liability period (10 years).  The data processing is based on the legal provisions of § 96 para. 3 TKG and Art 6 para. 1 lit a (consent) and/or lit b (necessary for the performance of the contract) of the DSGVO

Rights as person concerned
You have the right of access to your personal data, as well as the right to correct or delete or limit the processing. They may also object to the processing and have the right to have their personal data communicated in a structured, machine-readable form. For all the above rights, please contact the contact details of the data controller.

Right of appeal
They also have the right to lodge a complaint with a supervisory authority.

Privacy Policy

  • 14. Place of jurisdiction and applicable law

(1) Austrian substantive law shall apply to this contract to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the country in which he has his habitual residence shall also apply to this contract.
(2) For disputes, the court having subject-matter jurisdiction at the registered office of Paradine GmbH shall have exclusive jurisdiction.
If the customer is a consumer within the meaning of the Consumer Protection Act (KSchG), the jurisdiction of the court in whose district the residence, habitual abode or place of employment of the customer is located shall be deemed to be established.
(3) Place of jurisdiction and place of performance of the contract is the registered office of Paradine GmbH.
